Candidates Terms & Conditions

1. Introduction
These Candidate Terms and Conditions ("Terms") govern the relationship between you (the "Candidate") and Handpicked Talent ("we," "us," or "our") when you register with our recruitment services. By submitting your information or engaging with our services, you agree to these Terms.

2. Our Services to Candidates
2.1 Handpicked Talent provides talent acquisition services connecting candidates with employers in the science and technology sectors.
2.2 Our services to you are provided free of charge. We are compensated by employers who hire candidates we introduce.
2.3 We will consider you for roles that match your skills, experience, and career objectives, but we cannot guarantee job placement or interviews.
2.4 We are under no obligation to submit your profile to any specific employer or for any specific role.

3. Candidate Obligations
3.1 Accurate Information: You agree to provide truthful, accurate, and complete information about your education, work history, skills, and qualifications.
3.2 Updates: You will promptly inform us of any changes to your contact information, availability, or job search status.
3.3 Authorized Representation: You authorize us to represent you to potential employers and present your profile for suitable opportunities.
3.4 Interview Attendance: If we arrange an interview, you agree to attend as scheduled or provide reasonable notice if you must cancel.
3.5 Direct Communication: You will not contact employers we introduce you to directly without our prior knowledge and consent during the recruitment process.
3.6 Honesty: You will not misrepresent your qualifications, provide false references, or withhold material information that could affect hiring decisions.

4. Your Information and Privacy
4.1 Data Collection: We collect personal information, including your resume, contact details, work history, and other relevant professional information.
4.2 Data Use: We use your information solely to:

Maintain records of our recruitment activitie.s
4.3 Data Sharing: We will only share your information with potential employers with your consent, which you grant when we submit you for a specific role.
4.4 Data Protection: We implement reasonable security measures to protect your personal information.
4.5 Your Rights: You have the right to:

Request deletion of your information (subject to our legal obligations)

Withdraw from our database at any time
4.6 Retention: We retain your information for 24 months from your last interaction with us, unless you request earlier deletion or we have legal obligations to retain it longer.

5. Confidentiality
5.1 Information shared with you about potential employers, roles, and compensation during the recruitment process is confidential.
5.2 You agree not to share this information with third parties or use it for purposes other than evaluating the opportunity.
5.3 We will treat your job search as confidential and will not disclose it without your permission.

6. Non-Circumvention
6.1 If we introduce you to an employer, you agree not to bypass us by applying directly or through another agency for 6 months from the date of introduction.
6.2 If an employer hires you, we introduced you to the employer within this period, and you acknowledge that we are entitled to our placement fee from the employer.
6.3 This does not prevent you from responding to public job postings by the employer if they are genuinely advertised openly.

7. Employment Relationship
7.1 Handpicked Talent is a recruitment consultant only. We do not employ candidates.
7.2 If hired, your employment relationship is directly with the employer, not with us.
7.3 The employer determines all employment terms, conditions, and compensation.
7.4 We are not responsible for any aspect of your employment, including but not limited to: pay, benefits, working conditions, or termination.

8. References and Background Checks
8.1 You authorize us to verify your employment history, education credentials, and references as needed.
8.2 You understand that employers may conduct their own background checks, reference checks, and verification processes.
8.3 You agree to cooperate with reasonable verification requests.

9. Withdrawal of Candidacy
9.1 You may withdraw from any recruitment process at any time by notifying us promptly.
9.2 If you accept an offer through us and then withdraw before your start date, we request at least 48 hours' notice to inform the employer professionally.
9.3 You will notify us immediately if you accept employment elsewhere or are no longer seeking new opportunities.

10. Multiple Submissions
10.1 If you are working with multiple recruitment agencies, you must inform us to avoid duplicate submissions to the same employer.
10.2 In case of duplicate submission, the agency that submitted you first typically has priority for placement fees.
11. Disclaimer and Limitation of Liability
11.1 We make no representations or warranties about:

The availability of specific roles

The accuracy of job descriptions provided by employers

The outcome of any interview or application process

The suitability or legitimacy of any employer
11.2 We are not liable for:

Any employment decisions made by employers

Any loss or damage arising from your participation in interviews

Delays or changes in the hiring process

Any disputes between you and an employer
11.3 Our total liability to you shall not exceed [CAD $200 / USD $200].

12. Compliance
12.1 You agree to comply with all applicable employment laws and regulations.
12.2 You will not engage in discrimination or harassment during the recruitment process.
12.3 You have the legal right to work in the United States or will obtain necessary work authorization before accepting employment.

13. Feedback and Complaints
13.1 We welcome your feedback about our services and the recruitment process.
13.2 If you have any complaints, please get in touch with us at beethoven@handpickedtalent.com, and we will work to resolve them promptly.

14. Termination
14.1 You may terminate your relationship with us at any time by requesting removal from our database.
14.2 We may terminate our services to you if you breach these Terms or engage in misconduct.
14.3 Termination does not affect introductions already made or recruitment processes already underway.

15. Governing Law
15.1 These Terms are governed by the laws of the State of California.
15.2 Any disputes shall be subject to the exclusive jurisdiction of the courts of Alameda County.

16. Changes to Terms
16.1 We may update these Terms from time to time. Material changes will be communicated to active candidates.
16.2 Continued engagement with our services after changes constitutes acceptance of the modified Terms.
